Set-up-a-Company-in-the-Healthcare-Field-in-Spain.jpgThe registration of a company operating in the Spanish healthcare field is performed according to the regulations also applicable  to other commercial legal entities operating on the local market. Depending on the business activities of the company, the investors will need to obtain special permits according to the applicable legislation. Our team of Spanish lawyers can offer legal assistance on the registration aspects related to the healthcare businesses

Opening a Spanish company

Foreign businessmen can open a company in Spain following the same rules of law available for local investors. The first aspect that should be completed during the registration of the company is the verification on the availability of the company’s trading name, a procedure which can be completed at the Central Commercial Registry

Later on, the company will need to be registered as a business form, a procedure that will be concluded in front of a public notary in Spain, who is the authorized entity for the validation of the company’s founding documents

A company performing commercial activities in Spain will need to obtain an identification tax code. It will also be necessary to register for other taxation requirements, and our team of attorneys in Spain can offer more details on this incorporation procedure.

As the healthcare company in Spain will also need employees to carry out its activities, the investors will have to register with the Social Security General Treasurership. Since the day in which this procedure is completed, the company is obliged to provide the employment contracts of the personnel, in a period of maximum 10 days.

Regulations for healthcare companies in Spain

Companies in Spain that are involved in manufacturing, selling or trading pharmaceutical products are required to apply the regulations available under the Royal Legislative Decree 1/2015 (the Law on Guarantees and Rational Use of Medicines and Medical Devices).

The legislation provides the regulatory framework for the pricing policies established on the local market, as well as on the distribution and authorization of such products.

Persons who need further information on the regulations referring to the Spanish healthcare companies are invited to contact our law firm in Spain.
